NOTICE TO CLIENTS
1. PHOTOGRAPHY AND VIDEOGRAPHY AUTHORIZATION
By participating in any travel experience, tour, excursion, or activity organized by Authentic Horizons Travel, LLC ("Company"), you hereby acknowledge and agree that you and any minors in your party may be photographed and/or videotaped by Company representatives, employees, contractors, or authorized third parties during your trip.
2. PERMITTED USE OF IMAGES AND RECORDINGS
All photographs and video recordings captured during your travel experience may be used by Company for any and all lawful purposes, including but not limited to:
- Marketing and promotional materials
- Company website and digital platforms
- Social media pages and posts (including but not limited to Facebook, Instagram, TikTok, YouTube, Twitter/X, and similar platforms)
- Email marketing campaigns
- Print advertisements
- Television or streaming media advertisements
- Press releases
- Travel brochures and collateral materials
- Archive and portfolio purposes
3. GRANT OF RIGHTS
You hereby grant to Authentic Horizons Travel and its successors, assigns, and licensees, a perpetual, worldwide, royalty-free, non-exclusive license to use, reproduce, modify, distribute, and publicly display all photographs and video recordings in which you appear, without further notice, compensation, or approval from you.
4. NO EXPECTATION OF PRIVACY
By participating in Company-organized activities, you acknowledge that you have no expectation of privacy regarding photography or videography in public spaces or designated Company-controlled areas.
5. WAIVER AND RELEASE
You hereby release, discharge, and hold harmless Authentic Horizons Travel, its owners, officers, employees, agents, contractors, and representatives from any and all claims, demands, actions, or causes of action arising from or related to the use of your image or likeness, including but not limited to claims for invasion of privacy, right of publicity, defamation, or copyright infringement.
6. ASSUMPTION OF RISK
You acknowledge that you have voluntarily assumed any risks associated with being photographed or videotaped, including but not limited to potential unauthorized sharing of images on social media or third-party platforms.
7. OPT-OUT PROCEDURE - WRITTEN NOTICE REQUIRED
If you do not wish to be photographed or videotaped, you MUST submit written notice of your opt-out election prior to your trip departure date.
Opt-Out Requirements:
- Notification Method: Written notice must be submitted via email to info@authentichorizons.com, postal mail to P.O. Box 547 Pooler, GA 31322, or delivered in person to Company offices
- Timing: Notice must be received by Company no later than 15 business days prior to your scheduled departure date
- Required Information: Your opt-out notice must include:
- Your full legal name
- Your booking/confirmation number
- Your scheduled trip dates
- Your explicit statement that you do not consent to photography or videography
Failure to Opt-Out:
Failure to submit timely written notice constitutes your affirmative consent to all photography and videography as described herein.
8. MINORS AND PARENTAL CONSENT
Parents or legal guardians accompanying minor children (under 18 years of age) acknowledge that by participation in Company-organized activities, they hereby provide consent on behalf of all minors in their party. Parents and guardians remain fully responsible for providing timely opt-out notice on behalf of minors if they do not wish minors to be photographed or videotaped.
9. THIRD-PARTY SHARING
Company may share photographs and video recordings with third-party marketing vendors, travel partners, tour operators, or social media management firms for purposes consistent with Section 2 hereof. By accepting this policy, you acknowledge and consent to such third-party sharing.
10. LIMITATION ON LIABILITY
Company shall not be liable for any unauthorized use of photographs or recordings by third parties, including but not limited to unauthorized reposting on social media platforms or other websites, provided that Company has taken reasonable precautions to protect such content.
11. MODIFICATION OF IMAGES
Company reserves the right to modify, edit, crop, enhance, or alter photographs and video recordings for aesthetic or technical purposes without further notification to you.
12. NO COMPENSATION
You acknowledge that you will receive no monetary compensation, residuals, or other consideration for the use of your image or likeness.
13. GOVERNING LAW AND JURISDICTION
This Photography and Videography Consent and Release Agreement shall be governed by and construed in accordance with the laws of the State of Georgia, without regard to its conflict of law principles. You hereby consent to the exclusive jurisdiction of the state and federal courts located in Savannah, Chatham County, Georgia for resolution of any disputes arising from this agreement.
14. SEVERABILITY
If any provision of this agreement is found to be invalid or unenforceable under Georgia law, such provision shall be severed, and the remaining provisions shall continue in full force and effect.
15. ENTIRE AGREEMENT
This policy constitutes the entire agreement between you and Company regarding photography and videography consent and supersedes all prior negotiations, representations, and agreements, whether written or oral.
ACKNOWLEDGMENT AND ACCEPTANCE
By participating in any Authentic Horizons Travel-organized trip or activity, or by executing a travel booking agreement, you explicitly acknowledge that you have read this policy, understand its terms, and agree to be bound by its provisions.
Your participation confirms your consent to photography and videography unless you submit timely written opt-out notice as described in Section 7.
